These Terms of Service govern your use of excavons.com and any purchase you make from Excavons, operated by Excavons LLC. By using our website or placing an order, you agree to these terms. Last updated September 2026.

2. Products

We sell outdoor structures – pergolas, gazebos, pavilions and storage sheds. We make every effort to display product colors, dimensions and specifications accurately, but slight variations can occur between screens and finished products. Dimensions are approximate and may vary within normal manufacturing tolerances.

3. Pricing

All prices are shown in US dollars (USD). We reserve the right to correct pricing errors and to change prices at any time before you place an order. The price applicable to your order is the price displayed at the time you complete checkout.

4. Orders and contract formation

Our display of products is an invitation to treat, not an offer. Your order is an offer to buy; a contract is formed only when we accept your order by sending a dispatch confirmation. The order-acknowledgement email is not an acceptance. We may decline or cancel an order (for example, if an item is out of stock or a pricing error occurred) and will refund any payment taken.

5. Payment

We accept VISA,MASTER CARD,AMEX,APPLE PAY,GOOGLE PAY through our secure Stripe-powered checkout. Payment is taken at the time of order. See our Payment Policy for detail.

6. Shipping and delivery

Shipping is free within the contiguous US by curbside freight. Processing takes 1 – 2 business days and transit 5 – 9 business days. Delivery timeframes are estimates. Please see our Shipping Policy for full terms, including curbside delivery and inspection.

7. Title and risk

Title to the goods passes to you on receipt of payment in full. Risk of loss or damage passes to you on delivery.

8. Returns

You may return unused, uninstalled items within 30 days of delivery under our Refund and Return Policy.

9. Warranty and liability

Products are covered against manufacturing defects. Some states do not allow limitations on implied warranties or the exclusion of incidental or consequential damages, so some limitations may not apply to you. To the fullest extent permitted by law, our liability for any claim relating to a product is limited to the purchase price of that product. Nothing in these terms limits liability that cannot be limited by law.

10. Assembly and safe use

Our structures ship flat-packed and require assembly. Follow the included instructions, anchor structures as directed, and ensure any local permit or building-code requirements are met – these are the customer’s responsibility. Improper assembly, installation or anchoring may void manufacturer warranties.

11. Acceptable use

You agree not to misuse the website, attempt unauthorized access, or use our content without permission. All site content and trademarks are the property of their respective owners.

12. Disputes

If you have a problem, please contact our customer service team first – we resolve most issues quickly and directly. We do not require binding arbitration.

13. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Consumers retain any non-waivable rights under the laws of their state of residence.
